Jargon Support – Terms and Conditions

1. The Basics

By engaging Jargon Support for any website design, hosting, email, domain, or consulting services, you’re agreeing to these terms. Please take a few minutes to read them .. they’re written plainly so there’s no confusion down the track.

  • “Jargon Support”, “we”, “us”, or “our” refers to J.I Houghton & T.S Houghton ABN 30 917 396 062.
  • “You” or “Client” refers to the individual or business engaging our services.
  • “Services” refers to anything we supply, including websites, hosting, email, domains, and consulting.
  • “Handover” means the point at which your website goes live, or login credentials are delivered to you, whichever comes first.
  • “Start Date” means the date we notify you that work has begun.

2. Quotes and Payments

We accept payment by credit card, debit card, bank transfer, or cash.

  • Invoices under $1,000: full payment is required before work begins.
  • Invoices $1,000 or more: a 50% deposit is required to start, with the balance due before Handover.

All quoted prices are in Australian dollars and exclude GST, which will be added where applicable.

Quotes are valid for 28 days from the date issued. We reserve the right to adjust pricing before an order is confirmed, or if our costs change due to factors outside our control (such as platform pricing changes).

Late or failed payments may result in work being paused or services being suspended. If a bank transfer hasn’t been received within 5 business days of the due date, we’ll follow up in writing. Continued non-payment may result in cancellation under Section 6 of these terms.

Credit card renewals: by paying recurring services by credit card, you authorise automatic renewal. We’ll do our best to remind you beforehand, but it’s your responsibility to notify us in writing at least 14 days before a renewal date if you’d like to cancel.

Ownership of all completed work transfers to you only upon receipt of full payment.


3. Your Responsibilities

To keep things moving, we’ll need your help. By engaging us, you agree to:

  • Provide content, images, logins, and approvals in a timely manner
  • Ensure all materials you supply are accurate and don’t infringe anyone else’s copyright
  • Review and approve all content before your site goes live .. once you’ve given the green light, the Handover period begins
  • Maintain appropriate antivirus protection on your own systems

Branding Assets

We don’t design logos or brand identities. To complete your website, you’ll need to provide:

  • Your logo file (preferably PNG or SVG with a transparent background)
  • Your brand colours (hex codes if you have them, or just tell us what you use)
  • Your preferred fonts, if you have them

If you don’t have these ready, we’ll work with what you give us and make reasonable choices on your behalf .. but any changes to fonts or colours after work has begun will be treated as additional work and quoted accordingly.

Hosting and maintenance fees begin from the Start Date and continue through the build, even if the project is delayed on your end.


4. Scope of Work

The work we complete is based on what’s outlined in your invoice. If something isn’t listed, it’s not included.

Once your site goes live (or credentials are delivered), Handover is complete. We’ll fix any errors we’ve made within 7 days of Handover at no charge. After that, any additional changes will be quoted and billed at our standard hourly rate.

We won’t start extra work without giving you a written estimate first.

Platform Limitations

Our services are built on third-party platforms including WordPress, WP Engine, Synergy Wholesale, and Microsoft 365. We work within the capabilities these platforms provide. If a feature you’ve requested isn’t technically possible on your chosen platform, we’ll let you know and offer an alternative where we can .. but no refund applies if a specific feature can’t be delivered due to platform constraints.

We don’t provide custom coding outside of standard plugin, theme, and platform configuration.

Website Admin Access

We don’t provide full admin access to your WordPress dashboard, cPanel, SFTP, or third-party hosting panels as standard. This keeps your site secure and supportable.

If you need a specific level of access, raise it with us in writing and we’ll consider it on a case-by-case basis. If access is granted, you take on full responsibility for any changes made and any issues that result.


5. Hosting and Third-Party Services

If your services include hosting, you agree to the relevant provider’s terms:

We resell these services on your behalf. We’re not responsible for outages, data loss, security breaches, or service changes caused by these providers. In the event of an issue, we’ll pass on any relevant notices from the provider, but you may need to deal with them directly for resolution.


6. Cancellations

A $50 + GST administration fee applies to all cancellation requests.

  • Ongoing services (hosting, maintenance, email): cancel anytime with 14 days written notice. No pro-rata refunds.
  • One-off projects: cancel within 24 hours of placing your order for a refund, minus any work already started. After 24 hours, you’re liable for any work completed to that point, and we may invoice for the full project cost depending on how far along we are.

No refunds are issued after Handover. Once your site is live and delivered, the job is done.

We also reserve the right to cancel services if these terms are breached, or if unlawful activity is involved.


7. Maintenance

Websites need ongoing care to stay secure and functional. As part of your ongoing service, regular software updates are included. However, manual fixes required as a result of those updates (plugin conflicts, layout issues, etc.) may be quoted separately.

If you’re managing your own maintenance, you’re responsible for:

  • Keeping software, plugins, and themes updated
  • Maintaining regular backups
  • Testing your site regularly (forms, payments, phone numbers, etc.)
  • Holding appropriate cyber insurance for data breaches

If you skip these steps and something goes wrong, we’re not liable for the fallout.


8. Our Liability

We’ll always do our best work, but we’re a small operation and we want to be upfront about our limits.

  • We don’t guarantee error-free or uninterrupted service
  • We’re not liable for issues caused by third-party platforms
  • Our total liability is capped at the amount you paid for the specific service in question
  • We’re not liable for indirect losses (lost revenue, missed opportunities, etc.)

Your services come with the protections guaranteed under Australian Consumer Law (ACL), and nothing in these terms overrides that.


9. Privacy and Confidentiality

We handle your information in line with the Privacy Amendment (Private Sector) Act 2000 and the National Privacy Principles. We don’t share your details with anyone unless required by law.

Likewise, both parties agree to keep sensitive project information confidential.


10. Disputes

If something’s not right, please talk to us first. We’d much rather sort things out directly than involve lawyers. If we can’t resolve it between ourselves, we agree to attempt mediation before taking any legal action.

These terms are governed by the laws of Queensland, Australia.


11. General

  • We reserve the right to photograph or reference completed work for our portfolio and marketing, unless you ask us not to in writing.
  • If any part of these terms is unenforceable, the rest still stands.
  • We’re not liable for delays or failures caused by events outside our control (natural disasters, platform shutdowns, etc.).
  • Notices sent by email are considered received once successfully delivered.
